SPOOKY COMPETITIONS LTD – COMPETITION TERMS AND CONDITIONS ("T&Cs")
www.spookycompetitions.com
THE PROMOTER AND THE T&CS
1. The promoter of all the competitions on our website ("Our Website"): www.spookycompetitions.com is SPOOKY COMPETITIONS LTD of Unit 20 Ptarmigan Place, Attleborough Fields Industrial Estate, Nuneaton, Warwickshire, CV11 6RX (Co. No. 16323850, "SPOOKY COMPETITIONS LTD, we, our, us"). Our email address is [email protected] ("Our Email Address"). The Competition Manager for the purposes of paragraph 3 of Schedule 1 is George Green, of Unit 20 Ptarmigan Place, Attleborough Fields Industrial Estate, Nuneaton, Warwickshire, CV11 6RX. "Paragraph" shall mean a paragraph in the T&Cs.
2. The T&Cs shall apply to all the competitions advertised on Our Website. By submitting a competition entry, you agree to be bound by the T&Cs in force at that time. We may make changes to the T&Cs from time to time, so please check them every time you use Our Website, to ensure you are aware of the T&Cs then current.
THE COMPETITION
3. Each competition we run ("the Competition") is described on its own page on Our Website ("Competition Page"). The Competition Page sets out the details of that Competition, and may also state the maximum number of entries we will accept before we close the Competition.
HOW TO ENTER
4. The Competition will be open until the date and time ("the Closing Date") shown on the Competition Page. Where more than one date or time is shown, the Closing Date is the latest of them.
5. All Competition entries must be received by us by no later than the Closing Date, and any received after the Closing Date will be automatically disqualified.
6. No purchase is necessary to enter or win any Competition. A free entry route is available for every Competition, and entries made by a free route are treated no less favourably than paid entries and have an equal chance of winning. Each Competition entry is represented by a unique number ("Entry Number") for which a payment is to be made (unless the free postal or phone entry route is used) as indicated on the Competition Page. To obtain an Entry Number, there are three available routes:-
EITHER
PAID ONLINE COMPETITION
6.1 you enter the Competition online, via the Competition Page, by paying the stated price per entry, either choosing, or according to your choice being allocated, an Entry Number or Numbers (each one being a separate transaction between us). NOTE: you will open a free online account, registering your details online;
OR
FREE POSTAL COMPETITION
6.2 you enter the Competition for free by complying with Our postal entry requirements fully set out in Schedule 1 below, so that you can be allocated an Entry Number for each postcard received from you (each one being a separate transaction between us). NOTE: you must open a free online account via the Competition Page, registering your details online;
OR
FREE PHONE COMPETITION
6.3 This alternative, free-entry method is applicable only to a Competition which runs for four days or less, measured from the time it goes live on Our Website to the Closing Date. Such a Competition is identified by the words "QUICK DRAW" in its name. The free postal entry method in Schedule 1 is available on every Competition and is not limited in this way. For such competitions, it will be necessary for you to call 07983644446 and provide your name, address, date of birth, contact telephone number and email address, as registered by you. A random Entry Number will then be allocated to your call, and emailed to you. For any competitions with a longer time-span, our free postal entry method only should be employed.
and, in each case, please ensure you have read the T&Cs before entering, as entering the Competition creates a legally-binding contract between us to which the T&Cs apply. We recommend that you print and retain, or save to your device, a copy of the T&Cs for future reference.
THE DRAW
7. The winner ("the Winner") of the Competition, and therefore of the prize described on the Competition Page ("the Prize"), will be selected from amongst all the chosen or allocated Entry Numbers by TrueNorth, the certified random number generator provided by our website platform provider. Each draw carried out through TrueNorth is committed in advance and can be independently verified, so that the result can be checked rather than taken on trust. In the event that access to TrueNorth is unavailable, We may have to use another random number generator, such as the Google random number generator or www.random.org, or similar technology. The draw will be carried out either:-
7.1 Live, in which case the draw may be observed on one of the social media pages whose logo is shown on the Competition Page; or
7.2 automatically by Our Website, shortly after the Closing Date.
7.3 Where a Competition sells out before its Closing Date and We have chosen to draw it on sell-out, the Competition closes at that point and the draw is carried out then, rather than on the advertised draw date. Where We have not chosen to draw on sell-out, the Competition closes to new entries on sell-out but the draw still takes place on the advertised date.
8. Competition entries made via the paid online route are non-refundable, unless We cancel the Competition (as to which see Paragraph 9).
8.1 An Entry Number is allocated to you immediately upon entry, so performance of Our contract with you begins straight away and is complete once that Entry Number has been allocated. You therefore have no right to cancel a Competition entry under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. This does not affect your statutory rights in respect of Our service generally.
CANCELLATIONS OR EXTENSIONS
9. We may by notice on Our Website:-
9.1 cancel any Competition in the event of a force majeure event, as defined in Schedule 2, but then We will refund all entry fees; or
9.2 cancel or correct a Competition which has been advertised with an obvious error in its price, its description or the Prize offered, in which case We will refund all entry fees paid for that Competition; or
9.3 extend the Closing Date of a Competition, but only where a force majeure event, a serious technical failure affecting access to Our Website, or another emergency has prevented entrants from entering. We will not extend the Closing Date of a Competition because of the level of sales, in any circumstances. Subject only to this Paragraph 9.3, the draw will take place on the published date whether or not all Entry Numbers have been allocated, and the Prize will be awarded.
ELIGIBILITY
10. Our Competitions are open to those 18 years of age or over and resident in England, Scotland, Wales or Northern Ireland only (and not available for use in other locations), although we wish to clarify that they are not open to:-
10.1 Our employees, or employees of Our holding or subsidiary companies;
10.2 employees of Our agents or suppliers or their holding or subsidiary companies, who are professionally connected with the Competition or its administration; or
10.3 members of the immediate families or households of any of the above.
11. By entering the Competition, you confirm that you are eligible to enter and to claim any prize you may win AND for these purposes:-
(a) We may require proof of your eligibility; (b) you accept full responsibility for any entry into a Competition outside of these eligibility requirements and for ensuring that you do not contravene any applicable law; (c) We do not accept any responsibility for any unlawful Competition entries; (d) no refund shall be made in respect of any entry found to be ineligible; and (e) We may conduct age verification procedures to ensure compliance with the law, by which entrants and Winners may be required to provide proper identification (with photo-ID) to verify their identity, age and place of residence.
12. We will not accept any entries that We reasonably believe:-
(a) were automatically generated by computer; (b) were completed by third parties; (c) were bulk entries; (d) are illegible, have been altered, reconstructed, forged or tampered with; (e) were received after the Closing Date; (f) cannot be matched to a registered entrant; (g) to be incomplete; or (h) part of a series or scheme using multiple names and addresses, in which case all associated entries will be voided (whether by the paid or free entry route). Entries on behalf of another person will not be accepted and joint submissions are not allowed.
13. We accept no responsibility for prospective entrants being unable to connect to Our Website to participate in any Competition due to any technical or other problem relating to an email or web connection. Further, proof of transmission does not amount to proof of receipt.
14. The Competition Page may set out the maximum number of entries per person for that Competition (whether online or via the free postal route).
15. Conduct contrary to the spirit or intention of the Competition may lead to disqualification at our absolute discretion.
YOUR ACCOUNT AND SITE CREDIT
16. Payments for Competition entries are non-refundable, save as set out in Paragraph 9.
17. Your account holds a single balance of site credit ("your Wallet"). Your Wallet may be credited by:-
17.1 prizes won through an Instant Win game or a Competition where the prize is awarded as site credit; 17.2 any refund We make to you; and 17.3 any cashback or promotional credit We choose to award.
You cannot pay money into your Wallet yourself. Everything in it is prize money, a refund, or credit We have given you.
18. Site credit in your Wallet may be used to pay for Competition entries, in full or in part. Where you have site credit available it is applied automatically at checkout, so the amount used is deducted from your Wallet balance and reduces what you pay by card by the same amount. Your remaining balance is shown in your account.
19. You may request withdrawal of site credit from your Wallet, subject to a minimum withdrawal of £10.00. Site credit below the minimum withdrawal amount remains in your Wallet and may be used to enter any Competition. In addition:-
19.1 Withdrawals are paid in pounds sterling, by bank transfer, to a bank account held in your own name. We do not accept payment from, or make payment to, any third party;
19.2 before making a payment We may ask you to verify your identity, your age and your address, and to account for the source of funds held in your Wallet, and We may withhold payment until you have done so;
19.3 We may require that only one withdrawal request is outstanding at a time; and
19.4 where We reasonably suspect fraud, money laundering or any other unlawful activity, or any of the conduct described in Paragraph 58, We may suspend your account, withhold any withdrawal and retain any Prize pending investigation, and We may report the matter to the police or any other authority.
20. Where a Prize is described on the Competition Page in cash terms (for example "£100 Cash"), that Prize is awarded as site credit of the stated amount, credited to your Wallet. Site credit is worth the same in pounds as the amount stated, and it is real money: you may spend it on Our Website, or withdraw it as pounds sterling by bank transfer to your own bank account, in accordance with Paragraph 19.
THE PRIZE
21. The Prize will be as described on the Competition Page and, following the draw, the Entry Number winning the Prize will be displayed there, as mentioned in Paragraph 27.
22. The Competition Page may also display the alternative cash prize, which the Winner may elect to take in lieu of the Prize. Such election must be made by the Winner by email to Our Email Address, marked for the attention of the Competition Manager, within five working days after the winning Entry Number has been displayed on the Competition Page or the date on which we make direct contact with the Winner, as mentioned in Paragraph 26.2, whichever is the later.
23. The Prize is neither negotiable nor transferable.
24. We reserve the right to substitute for the Prize a cash prize at least equal to the cash value of the Prize, taking into account any original discounts on price, if:-
24.1 the Prize, or a reasonable alternative to it, becomes unavailable; or 24.2 circumstances beyond Our reasonable control make it necessary for us to do so.
WINNERS
25. Our decision as to all matters where we have a discretion, or where we apply the rules of these T&Cs, is final, subject to your right to ask Us to review that decision under Paragraph 56.
26. After the Closing Date, We will:-
26.1 not amend the contact information you have registered with Us; and 26.2 contact the Winner personally as soon as practicable, at Our discretion either by email, using the email address provided upon registration, or by telephone.
27. Within 7 days after the Closing Date, We will publish the Winner on the Competition Page, showing the Winner's name in the shortened form used on Our Website (their first name and the initial of their surname) together with the winning Entry Number. Where the draw has been carried out through TrueNorth, the Competition Page will also show the draw details and confirmation that the result was independently verified, with a link by which anyone may check that result for themselves. Recent Winners are also listed on the results page of Our Website in the same form. Where We announce the Winner on Our own social media channels, We may also give the Winner's town or county of residence. We will ask the Winner before using their photograph or including them in any other publicity, and the Winner may decline without affecting their Prize.
CLAIMING AND DELIVERY OF THE PRIZE
28. Delivery of the Prize to the Winner may take up to 14 days. Where the Prize is awarded as site credit under Paragraph 20, it is credited to your Wallet automatically and is available immediately.
29. Delivery of the Prize will either be in person, or via a courier or delivery service (as determined by us). The cost of delivery is borne by us unless stated otherwise from the outset on the Competition Page. A delivery charge may be made for bespoke delivery requirements of the Winner or for re-deliveries.
30. We will make all reasonable efforts to contact the Winner. If the Winner cannot be contacted or is not available or has not claimed the Prize within 21 days after the Winner is announced, We reserve the right to offer the Prize to the next eligible entrant selected from the Entry Numbers allocated before the Closing Date, using the same method as previously mentioned.
31. If the Winner is unable to take up the Prize, or fails to do so within 21 (twenty-one) days after the Winner is announced, the Prize shall then become unavailable to the Winner and We shall have no liability whatsoever to the Winner.
32. If the Prize is a motor vehicle, We will offer to transfer title to the vehicle using DVLA Form V5C, completed before the vehicle is handed over, Provided That it will be the Winner's responsibility to tax and insure the vehicle. We shall have no responsibility for the vehicle once it has been delivered.
LIMITATION OF LIABILITY
33. So far as is permitted by law, we, Our agents or distributors will not in any circumstances be liable to compensate the Winner, nor have any liability for any loss, damage, personal injury or death occurring, as a result of taking up the Prize, except where it is caused by the negligence of us, Our agents or distributors or that of Our or their employees. Subject to that, your statutory rights are not affected.
OWNERSHIP OF COMPETITION ENTRIES AND INTELLECTUAL PROPERTY RIGHTS
34. All Competition entries and any accompanying material submitted to us will become Our property on receipt and will not be returned.
35. By obtaining your Entry Number and submitting any accompanying material, you agree to:-
35.1 assign to us all your intellectual property rights in your Competition entry and any accompanying material absolutely and with full title guarantee; and 35.2 waive all moral rights in and to your Competition entry, and otherwise arising in connection with your entry to which you may now or at any time in the future be entitled under the Copyright, Designs and Patents Act 1988, as amended from time to time, and under all similar legislation from time to time in force, anywhere in the world.
DATA PROTECTION AND PUBLICITY
36. We will process your personal information in accordance with Our Privacy and Cookie Policy and as mentioned above under "Winners".
37. If the Competition offers a Prize in partnership with a third party, We will ask the Winner before sharing their email address with that party, and the Winner may decline without affecting their Prize. Where a Winner agrees, they may unsubscribe from that third party's emails at any time using the unsubscribe link at the foot of the email or, if there is none, by emailing that third party.
38. By registering with us your details, you agree that We may send you future promotional materials by email from time to time, such as Our newsletter and details of special offers that may be of interest. You may unsubscribe from this at any time in accordance with Our Privacy and Cookie Policy.
GENERAL
39. If there is any reason to believe that you are or have been in breach of these T&Cs, We may, at Our sole discretion, reserve the right to exclude you from participating in any of Our competitions.
40. Events (including but not limited to events of force majeure) may occur that render the awarding of the Prize impossible due to reasons beyond Our reasonable control and then We may at Our absolute discretion vary, suspend, cancel or amend the Competition, and the entrant agrees that We shall have no liability in such circumstances.
41. The Competition draw will be either:-
41.1 live streamed, so that the public may follow it via Facebook Live or another social media channel, as mentioned on Our Website; or 41.2 carried out automatically by Our Website,
and in each case the Winner is selected by TrueNorth as set out in Paragraph 7.
42. For the purposes of the Contracts (Rights of Third Parties) Act 1999 and otherwise, only you and Us (and no other party) may claim that the terms of the contract between us confer a benefit, either expressly or as a matter of contractual construction, on any other party.
43. All non-compliant entries will be deemed void.
44. The Website terms and conditions set out in Schedule 3 shall also apply Provided That, where the content of Schedule 3 conflicts with the T&Cs, the T&Cs shall prevail.
45. English law shall apply to Our Website and the T&Cs, and the English courts shall have exclusive jurisdiction in relation to any dispute over them.
INSTANT WINS
46. Some Competitions offer Instant Win Prizes, which are attached to particular Entry Numbers and revealed to you when you obtain that Entry Number. Instant Wins are available equally to entrants using the paid online route and to those using the free postal or free phone routes. Where the Competition Page describes an Instant Win Prize in cash terms, that Prize is awarded as site credit in accordance with Paragraph 20.
47. The Entry Numbers carrying Instant Win Prizes are allocated before the Competition opens for entries, and are drawn from the Entry Numbers that have not yet been allocated to any entrant. We do not choose which Entry Numbers carry an Instant Win Prize. They are allocated at random before entries open, from Entry Numbers that have not then been allocated to anyone, and no entrant knows which Entry Numbers carry an Instant Win Prize before it is revealed. Where a Competition allocates Entry Numbers in sequence, it carries no Instant Win Prizes.
48. An Instant Win Prize may be revealed to you through an on-screen game (for example a wheel, a scratchcard or a reveal grid). The game is a way of presenting a result that has already been determined by the Entry Number you hold. Nothing you do while playing the game, and no skill you apply to it, changes whether that Entry Number carries a Prize.
49. So that entrants using the free postal route are not disadvantaged by the best Instant Win Prizes having been won before their postcard reaches us (in accordance with Schedule 1), a free-route entrant who is affected in that way will receive site credit which will be deemed sufficient payment for an Entry Number in the next Competition offering Instant Win Prizes no less valuable than the one they missed.
BOOSTED INSTANT WINS
50. From time to time We run promotions in which We increase the value of the Instant Win Prize attached to particular Entry Numbers, which We do at Our discretion. An Entry Number included in a promotion of this kind is marked on the Competition Page with the multiplier that applies to it, and may be shown on Our Website as a Gold Ticket or Golden Ticket (a "Boost"). A Boost does not change which Entry Numbers carry an Instant Win Prize, it does not change the chance of any Entry Number winning, and it does not create a separate competition. Where you win on a Boosted Entry Number, the ordinary value of the Instant Win Prize is paid into your Wallet automatically and the additional amount produced by the Boost is credited to you separately, as set out in Paragraph 52.
51. A Boost applies only to an Entry Number which was shown as Boosted at the time you obtained that Entry Number. Where a Boost had already ended at that time, the Instant Win Prize is awarded at its ordinary value.
52. Where you win a Boosted Instant Win Prize, the Prize is paid to you in two parts:-
52.1 the ordinary value of the Instant Win Prize is paid into your Wallet automatically at the time the Instant Win Prize is revealed to you, in accordance with Paragraph 20; and
52.2 the additional amount produced by the Boost is credited to your Wallet separately. We aim to credit that additional amount within 24 hours of the win, and will credit it within 5 working days of the win in any event.
53. A delay in crediting an additional amount under Paragraph 52.2 does not affect your entitlement to it. If it has not reached your account within 5 working days, please contact Us using the details in Paragraph 1 and We will put it right.
54. We may begin, change or end a Boost at any time and without notice. Ending a Boost does not affect an additional amount already won under it before it ended, which remains payable in accordance with Paragraph 52.
55. Where a Boost is displayed in error, or displays a multiplier other than the one We set, We will honour the Boost as it was displayed to you at the time you obtained the Entry Number, unless the error was obvious and you could reasonably have been expected to notice it.
COMPLAINTS AND APPEALS
56. If you are unhappy with a decision We have made under these T&Cs — for example a decision to reject an entry, to disqualify an entrant, or to withhold a Prize — you may ask Us to review it. Write to Us at the address in Paragraph 1, or email Us at [email protected], telling Us your name, the Competition concerned, your Entry Number if you have one, and why you believe the decision was wrong.
57. We aim to respond to a request under Paragraph 56 within three working days. Where We need longer, We will tell you why and when you can expect a full response.
58. Paragraphs 56 and 57 do not apply where We suspect fraud, money laundering or any other unlawful activity, or where We suspect that Our Website has been manipulated or that an entrant has otherwise sought an unfair advantage. That includes exploiting an error, defect or mispricing on Our Website; using automated, scripted or bulk means to enter; entering through more than one account, or using false or another person's details; interfering with a draw, an Instant Win or a Boost; and acting in concert with others to do any of those things. In those cases Our decision is final, We will not enter into correspondence or discussion about it, and We may report the matter to the police or any other authority.
59. For any other complaint about Our Website, a Competition or Our service, please use the complaints procedure published on Our Website. Nothing in these T&Cs affects your statutory rights, or your right to seek advice from Citizens Advice or your local Trading Standards service.
THE KIND SPIRITS FUND
60. The Kind Spirits Fund ("the Fund") is a voluntary goodwill fund operated by Us. We add 1p to it from every ticket bought on Our Website using a card payment, whether or not that ticket wins anything. Tickets paid for using Wallet credit do not add to the Fund, because that credit has already been paid out by Us as a prize; those tickets are entered into every draw in exactly the same way as any other. and We place a further £50 into it at the start of each calendar month from Our own money.
61. The Kind Spirits Fund is not a charity and is not collected for the benefit of any particular charity or charitable institution. Any payment made from it is a gift from Spooky Competitions Ltd to an individual or a family, and is not a charitable donation. We do not make payments from the Fund to companies, clubs, charities or other organisations.
62. Anyone who holds an account on Our Website may nominate any person, including themselves. You do not need to have entered a Competition, and the amount you have spent with Us has no bearing on a nomination, on whether it is considered, or on whether it is chosen.
63. NOMINATING SOMEONE ELSE. If you nominate another person you confirm that you are giving Us their details for this purpose and that you reasonably believe they would not object. We will not publish the name of a nominee or a recipient without asking that person first. We handle the information in a nomination in accordance with Our Privacy and Cookie Policy.
64. WE ARE NOT OBLIGED TO MAKE A PAYMENT, AND WE DO NOT GUARANTEE THAT ONE WILL BE MADE. The selection of a recipient is entirely at Our discretion. In particular:
64.1. where We receive no nominations in a given month, or no nomination that We consider suitable, We are under no obligation to make any payment for that month;
64.2. where no payment is made, the balance of the Fund is not retained by Us as profit — it is carried forward and added to the following month's Fund; and
64.3. Our decision on whether to make a payment, on who receives it, and on how much they receive, is final. We will not enter into correspondence or discussion about that decision, and Paragraphs 56 and 57 do not apply to it.
65. Where We do make a payment, We will normally pay the whole balance of the Fund at the end of the calendar month. We may pay it as site credit to the recipient's Wallet, or by bank transfer to an account in the recipient's own name, at Our discretion. We may ask a recipient to confirm their identity, their age and their address before We pay, and We may decline to pay where they do not.
66. The figure shown for the Fund on Our Website is indicative and is updated periodically. It is not a debt owed by Us to any person, and no entrant, nominator or nominee acquires any right, interest or entitlement to the Fund or to any part of it.
67. We may change the way the Kind Spirits Fund works, pause it, or end it at any time, including changing the amount contributed per ticket or the monthly amount We add. Where We end it, We will pay out the balance then held in accordance with Paragraph 65, or carry it forward to a further payment, at Our discretion. Ending or changing the Fund does not affect a payment already made.

5. Postal entries must be received by no later than the Closing Date and any received after the Closing Date will be automatically disqualified.
6. Entrants MUST have registered on Our Website by the time each postal entry is received by us and all details on postcards MUST match the name and address on the account to which they are to be linked. In the event that We are unable to identify the registered account-holder and match it to a postcard entry, that postcard will be rejected.
7. You will receive an email confirming receipt of your postal entry, letting you know that you have been entered into the Competition, together with your Entry Number. All postal entries are treated in the same way as entries using the paid route, and you will have an equal chance of winning the Competition as those who enter online.
8. We will not accept:-
(a) any responsibility for postcard entries that are lost, mislaid, damaged or delayed in transit beyond the Closing Date, regardless of cause, including, for example, as a result of any postal failure, equipment failure, technical malfunction, or systems, satellite, network, server, computer hardware or software failure of any kind; or (b) proof of posting or transmission as proof of receipt of entry into the Competition.

10. NOTE: one entry per postcard – multiple entries are restricted as mentioned on Our Website – if We believe one person is attempting to enter using multiple names and addresses, all associated entries will be voided, entries on behalf of another person will not be accepted and joint submissions are not allowed (as with the online paid entry route).
